ADC HoR Aspirant Drags Party, INEC to Court Over Alleged Unlawful Exclusion

In an Amended Originating Summons with Suit No: FHC/J/CS/51/2026, the claimant is also challenging the candidacy of Daniel Chirman, who was listed as the 3rd Defendant in the suit.

The case, filed pursuant to Sections 36 and 285 of the 1999 Constitution of the Federal Republic of Nigeria as amended, and Sections 85 and 88(2)(3) of the Electoral Act 2026, seeks the determination of the court on the alleged exclusion of the claimant from the party’s primary election.

In the suit, Hon. Danjuma Happy Sunday is asking the court to determine whether his purported disqualification from the ADC primary for Langtang North/South Federal Constituency without formal notice, reasons, or due process, is not unlawful, null and void.

The claimant contended that the action violated the provisions of the ADC Constitution, the Electoral Act 2026, and the principles of fair hearing.

The defendants in the suit are the African Democratic Congress as 1st Defendant, INEC as 2nd Defendant, and one Daniel Chirman as 3rd Defendant.

The court has ordered the defendants to enter appearance within 10 days of service of the originating summons.

The matter highlights growing concerns over internal party democracy and adherence to due process ahead of the 2027 general elections.
