The Court of Appeal, Makurdi Division, has affirmed the leadership of the Augustine Agada-led Benue State Executive Committee of the All Progressives Congress (APC), dismissing Appeal No. CA/MKD/119/2024 filed by the APC against the judgment earlier delivered by the Makurdi High Court.
In its judgment delivered on June 3, 2026, the appellate court upheld the decision of Justice T. A. Kume, which nullified the dissolution of the Agada-led State Executive Committee by the party’s National Working Committee (NWC) and invalidated the appointment of the Benjamin Omale-led Caretaker Committee.
Delivering the lead judgment on behalf of the panel leader, PJ Justice A.A. Wambaithe, the Presiding Judge, Justice A. Waziri ruled that all five issues raised by counsel to the appellant, S. D. Swem, Esq., and adopted and argued by M. T. Alyebo, Esq., representing Hon.
Augustine Agada and eight others, lacked merit and were resolved in favour of Agada and the other respondents.
The Court of Appeal further sustained the consequential order of the lower court declaring that all actions and decisions taken by the Benjamin Omale-led Caretaker Committee are “null, void, and of no effect whatsoever.”
A statement issued by the State Publicity Secretary, Daniel Morgan Ihomun says although, Mr. Benjamin Omale, who is listed as the 10th Respondent in the appeal, aligned with the submissions made by the APC, he did not file any separate process before the court.
Reacting to the judgment, Hon. Augustine Agada expressed confidence in the judiciary’s commitment to justice and called on party members to remain peaceful, united, and focused on strengthening the APC in Benue State.
